Terms of Service

These terms apply when you use cosmoness.com, Datum or Zymus (together, the "services"). By using the services, or by signing an order with us, you agree to them. If you use the services for a company or institution, you confirm you are allowed to accept these terms on its behalf, and "you" means that organisation.

If you have a separate written agreement with us, that agreement wins wherever it differs from these terms.

Datum connects to advertising, call tracking, CRM and payment tools you choose and reports which campaigns and calls led to closed revenue.

Zymus creates certificates from a list you provide, emails them to recipients and hosts a public verification page for each certificate.

We may improve or change features over time. If we remove something you rely on, we will tell you in advance where we reasonably can.

• Give us accurate information and keep it up to date.
• Keep your login details safe. You are responsible for what happens in your account.
• Tell us straight away if you think someone has accessed your account without permission.
• Only invite people you trust. Anyone you invite can see the data in your account.

You own the data you put into the services. You give us permission to store and process it only as needed to provide the services to you, as described in our Privacy Policy. We do not sell it and we do not use it to train AI models.

You are responsible for the data you put in. In particular, you confirm that:

• you have the right to connect each account and upload each list you use with the services;
• where the law requires it, the people in your data, such as certificate recipients or CRM contacts, have been told about and agreed to its use;
• the certificates you issue through Zymus are accurate, and recipients expect to receive them from you.

You must not use the services to:

• send spam, or email people who have not agreed to hear from you;
• issue false, misleading or forged certificates, or pretend to be another organisation;
• upload anything unlawful, or data you have no right to use;
• try to break into, overload, copy or reverse engineer the services;
• get around limits or security measures, or access another customer's data.

If you break these rules, we may suspend the affected part of your account straight away.

Datum and Zymus work with services run by other companies, such as Google Ads, Meta, CallRail, HubSpot, Salesforce, Stripe and Google Sheets. Your use of those services is governed by their own terms. We are not responsible for them, and if one of them changes or stops working, the parts of our services that depend on it may change too.

Fees are as agreed in your order or invoice. Unless stated otherwise, fees exclude taxes such as GST, which are added as required by law. If an invoice stays unpaid after a reminder, we may pause the service until it is settled.

We may offer trial accounts. A trial is free for the period we tell you, after which the account ends unless you choose a paid plan. Trials are provided as they are, without the commitments in section 13.

The services, our software, our logo and the Cosmoness, Datum and Zymus names belong to us. These terms give you the right to use the services, not ownership of them. If you send us ideas or feedback, we may use them freely without any obligation to you.

Each of us will keep the other's non-public business information confidential and use it only for the purpose of these terms. This does not cover information that is already public, that the other side already had, or that the law requires to be disclosed.

You can stop using the services and close your account at any time by emailing us. We can end these terms with 30 days' notice, or straight away if you seriously break them.

Before your account closes, you can ask us for an export of your data. After it closes, we delete your data as set out in our Privacy Policy. Withdrawing a Zymus account also takes its verification pages down, so plan this with your recipients in mind.

We work to keep the services running and secure, but we cannot promise they will never be interrupted. We may take them offline briefly for maintenance and will try to do so at quiet times.

We will provide the services with reasonable care and skill. Beyond that, and to the extent the law allows, the services are provided as they are, without other promises.

Datum's reports depend on the data your connected tools provide. They are there to inform your decisions, and those decisions, such as how to spend your ad budget, remain yours.

To the extent the law allows:

• neither of us is liable for indirect or consequential losses, or for lost profits, revenue or goodwill;
• our total liability for all claims in any 12 month period is limited to the fees you paid us for the services in the 12 months before the claim arose.

Nothing in these terms limits liability that cannot be limited by law.

If someone brings a claim against us because of data you put into the services, or because you broke section 6, you will cover our reasonable costs of dealing with that claim.

These terms are governed by the laws of India. The courts at Gautam Buddh Nagar, Uttar Pradesh have exclusive jurisdiction over any dispute arising from them. Before going to court, we both agree to try to settle the matter by talking first.

We may update these terms. We will change the date at the top of this page, and for significant changes we will email account holders at least 14 days before they take effect. If you keep using the services after that, the new terms apply.
